Creating a Private Label Program, Part 2

There are several ways to find out about private labeling laws in your state.

 

1. Call your state department of agriculture for information that governs private labeling. They may refer you to another department, but be persistent and get the details.

2. Another option is to contact your attorney or state bar association, two legal entities that will either share the details verbatim from law books or have access to the information and return your call quickly.

3. A law student can also be very helpful. Such a student will research the facts for a nominal fee or in exchange for a letter of appreciation written on your company letterhead.

When you are ready to sell private label products, some manufacturers will prepare personalized labels for you, usually for a fee.

Others leave products unlabeled and advise you about the labels that are best for packaging.

Labels available in office supply stores are usually acceptable. They are available in a variety of sizes, all of which will adhere to bags, boxes, and tins.

Before receiving your products for private labeling, there are two items to request from the manufacturers you chosen for these purchases.

1. Ask each wholesaler for a copy of their certificate of product liability insurance coverage. This is very important to ensure that your private labeled products are protected.

2. Ask to have your company’s name added to their insurance policy. This is done under the title, “Broad Form Vendor’s” coverage. This means that if any problems arise with the product, the manufacturer will take full responsibility for the situation.

It’s up to you to make sure that you know your state’s laws and get the facts from manufacturers before going forward with your private label program.

When visiting trade shows, ask manufacturers with products acceptable for your private label program if they have set up such a program. Then move forward to brand your business as one that caters to corporations, high-profile individuals, and others who prefer private label goods.
